Note Verbal on the Implementation of the UN General Assembly Resolution ES-10/24
With regard to the proposals for the Establishment of a Mechanism to Follow Up on Violations by Israeli regime of Article 3 of the International Convention on the Elimination of All Forms of Racial Discrimination as Identified by the International Court of Justice in its Advisory Opinion
The Permanent Mission of the Islamic Republic of Iran to the United Nations Office and other International Organizations in Geneva presents its compliments to the Office of the United Nations High Commissioner for Human Rights and, with reference to the note dated 16 October 2024, regarding the implementation of General Assembly resolution ES-10/24 entitled “Advisory opinion of the International Court of Justice on the legal consequences arising from Israel’s policies and practices in the Occupied Palestinian Territory, including East Jerusalem” has the honor to transmit herewith the views and legal proposal from the Islamic Republic of Iran on this matter. In line with Operative Paragraph 14 of the aforementioned resolution, the Permanent Mission of the Islamic Republic of Iran submits a legal proposal based on the ICJ Advisory Opinion, which highlights that Israel’s policies and measures, as identified by the Court, constitute a breach of Article 3 of the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD). The Enclosure demonstrates that Israel’s ongoing policies amount to a system of apartheid imposed on the Palestinian people. In this context, the Permanent Mission of the Islamic Republic of Iran proposes the establishment of an ‘Apartheid Committee’ under the United Nations framework, tasked with monitoring and investigating the apartheid crimes committed by the Israeli regime, as a mechanism to follow up on the violations identified in the ICJ advisory opinion. The Permanent Mission of the Islamic Republic of Iran avails itself of this opportunity to renew to the Office of the United Nations High Commissioner for Human Rights the assurances of its highest consideration.
